Why we collect personal information

FidoNet collects and uses your personal information to give you superior customer service, to provide you with convenient access to our products and services, and to make a wider ranger available to you. In addition, we use your personal information to keep you up to date on the latest product announcements, system updates, special offers, and other information we think you’d like to hear about. This may occasionally include information from other technology companies about products and services that can add value to your service. From time to time, we may also use your personal information to contact you to participate in a market research survey, so that we can guage customer satisfaction and develop better products.

How We Collect Your Personal Information

When you visit our Site, we collect the following types of Personal Information in order to provide you with use of and access to our Site and to help us personalize and improve your experience:

Information we collect automatically: When you visit our Site, email us, or download our mobile applications, we collect information sent to us by your computer, mobile phone, or other access device—some of which may be deemed Personal Information. The information sent to us may include but is not limited to the following: information about the pages you access,

computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad information, and standard web log Information and other information. We may also collect anonymous information through our use of cookies and web beacons.

Information you provide to us: We may collect Personal Information, such as your name, address, phone, email and other information that you enter directly onto or in connection with our Site. Generally, Personal Information are requested when: (i) FidoNet customers log into the Site for your products and services and (ii) when visitors to our Site request certain information about FidoNet products and services. If you fail to provide the requested Personal Information, you may not be able to access all or portions of the Site or purchase products and services.

Information we receive from other sources: We work closely with third parties (for example, business partners, service providers, sub-contractors, advertising networks, analytics providers, credit reference agencies, fraud protection services, channel partners, and resellers) and may receive information about you from them.

Social Media platforms or other forums: We may receive certain information that’s stored or processed by third parties, such as the social media sites Facebook®, Twitter® and LinkedIn® when you interact with us through these social media platforms. FidoNet Websites may include social media features – such as the Facebook “Like” button – and widgets – such as the “share this” button. These features may collect your IP address as well as details of the pages you are visiting on FidoNet Websites. Social media features and widgets are either hosted by a third party or hosted by FidoNet Websites. Each social media platform may have its own privacy notices that specifically govern its use of social media features.

FidoNet Websites may also feature bulletin boards, blogs or forums. Any Personal Information that you choose to submit via such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages.

Co-Branding: Some FidoNet Websites or Services may be co-branded and offered in conjunction with another company. If you use such websites or Services, both FidoNet and the other company may receive the Personal Information that’s collected via that co-branded website or Service. The company whose privacy notice is displayed on a co-branded website will be responsible for Personal Information collected on that website.

Other methods of collection: We may also collect Personal Information from or about you in other ways, such as through your contact with our customer support team, your results when you respond to a survey, and your interactions with members of the FidoNet corporate family or other companies.

Service Provider Information collection and processing: In some cases, FidoNet administers the Site on behalf of our customers, and in these circumstances we have no direct relationship with the individuals about, for, or from whom the Personal Information are collected. If you are a customer or end user of a FidoNet customer (for example, you are an end user of our customer ’s product or service ) and you have questions or complaints about how your Personal Information are processed, please contact our customer directly. You understand that your use of the Site may be subject to terms and policies provided by our customer and that FidoNet is not a party to such agreements.

How We Use the Personal Information We Collect; Purposes and Legal Bases for Processing

Our primary purpose for collecting and processing Personal Information is to provide you with a secure, smooth, and efficient visitor and customer experience. We may also use your Personal Information to:

  • operate the Site (the legal basis for processing is either performance of the agreement between us and you or our legitimate interest, more specifically our economic interest in offering you products and services);
  • provide support or to carry out the service(s) you have requested or authorised (the legal basis for processing is performance of the agreement between you and FidoNet);
  • troubleshoot your issue and provide you with more effective customer service (the legal basis for processing is performance of the agreement between you and FidoNet);
  • process payments for products or services you have purchased (the legal basis for processing is performance of the agreement between you and FidoNet);
  • distribute alerts concerning product upgrades, special offers, white papers, upcoming events and webinars, updated information about existing and new products and services from FidoNet or our partners and to measure the effectiveness of these communications (the legal basis for processing is either explicit consent, the performance of the agreement between you and FidoNet, or our legitimate interest, more specifically our economic interest in making you personalised offers);
  • provide or operate certain products or services that may engage in automated decision-making or profiling (the legal basis for such processing is explicit consent; you may withdraw your consent at any time); and
  • for such other purposes as required or permitted by law (the legal basis for processing is our compliance with our legal obligations).

When we disclose personal information

FidoNet works with other companies that help us provide products and services to you, and we may provide your personal information to these companies. For example, we give shipping companies this information so they can deliver your products efficiently. The information they receive is for shipping and delivery purposes only, and we require that the companies safeguard your personal information in accordance with FidoNet’s policies.

We may also share your information with credit reference agencies and other companies for use in credit decisions, for fraud prevention and to pursue debtors, as well as merchant service companies in order to facilitate payment of outstanding invoices.

At times we may be required by law or legal process to disclose your personal information. We may also disclose information about you if we believe that disclosure is necessary for the public interest.

How we protect your personal information

FidoNet safeguards the security of the data you send us with physical, electronic and managerial procedures. We urge you to take every precaution to protect your personal data when you are on the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser.

The FidoNet Store uses industry-standard Secure Sockets Layer (SSL) encryption on all Web pages where personal information is required. To make purchases from the FidoNet Store, you must use an SSL-enabled browser such as Netscape Navigator 3.0 or later, or Internet Explorer. This protects the confidentiality of your personal and credit card information while it is transmitted over the Internet.

How We Share Personal Information with Third Parties

FidoNet partners with and occasionally hires other companies to provide services on its behalf. Personal Information may be shared with these companies; however, we will only share your Personal Information to accomplish the purposes for which we collected the Personal Information. These third parties are contractually required to maintain the confidentiality of your Personal Information and are contractually prohibited from using that information for any other purpose.

We may also share your information as follows:

  • with your consent;
  • when we believe in good faith that disclosure is necessary to protect our rights or property;
  • to protect your safety or the safety of others;
  • to investigate fraud or respond to a government, judicial or other legal request;
  • with FidoNet group entities;
  • to comply with the law; and in connection with a corporate change, such as an acquisition or merger.

Collecting other personal information

When you browse the FidoNet Web site, you are able to do so anonymously. Generally, we don’t collect personal information when you browse – not even your email address. Your browser, however, does automatically tell us the type of computer and operating system you are using.

Like many Web sites, the FidoNet Web site uses “cookie” technology. When you first connect to our site, the cookie identifies your browser with a unique, random number. The cookies we use do not reveal any personal information about you, except perhaps your first name so we can welcome you on your next visit. Cookies help us understand which parts of our Web sites are the most popular, where our visitors are going, and how long they spend there. We use cookies to study traffic patterns on our site so we can make the site even better.

In some of our email to you, we use a “click-through URL”. When you click one of these URLs, you pass through our Web server before arriving at the Web site that is your destination. We track click-throughs to help us determine your interest in particular topics and measure the effectiveness of our customer communications.

Our Company-wide commitment to privacy

FidoNet’s Web site contains links to other sites. FidoNet does not share your personal information with those Web sites and is not responsible for their privacy practices. We encourage you to learn about the privacy policies of those companies.

If we are going to use your personal information differently from that stated at the time of collection, we will try to contact you via email using the most recent information we have. If you have not given us permission to communicate with you, you will not be contacted, nor will we use your personal information in a new manner.

The FidoNet Customer Privacy Policy is subject to change at any time. We encourage you to review the privacy policy regularly for any changes.

How We Protect and Store Personal Information

We endeavour to protect the security of your Personal Information. We use a variety of security technologies and procedures to try to protect your Personal Information from unauthorised access, use, or disclosure. For example, we store the Personal Information you provide on computer servers with limited access that are located in controlled facilities.

How You Can Opt Out of Marketing Communications

We may contact you to alert you of upcoming events, webinars, white papers and promotional campaigns relating to our products and services. If we determine that your explicit consent is needed to send marketing communications, we will obtain that consent before or at the time of Personal Information collection.

FidoNet honours your choices. You can choose whether you wish to receive promotional emails, SMS messages, telephone calls, and postal mail from us by using the opt-out methods described in that communication. For example, if you wish to stop receiving email marketing communications from us, you may click the “unsubscribe” link at the bottom of the relevant email marketing communication or by following the instructions detailed in the communication.

Please note that this may not unsubscribe you from all other communications. If you wish to opt-out of all marketing communications, please contact us using the details provided below. Please note that you cannot unsubscribe from service-related messages.

How You Can Access or Change Your Personal Information

You may contact us at any time to inquire about the Personal Information we collect about you. Depending on the Site you use, you may access, correct, or request deletion of your Personal Information by logging in to your account, or you may contact us at privacy@fido.net. We will respond to your request within a reasonable timeframe.

In the event FidoNet processes information about you on behalf of one of our customers, please direct your privacy inquiries and requests for access, correction or deletion of Personal Information to the customer. If a customer requests that we remove information, we will respond within a reasonable timeframe.

We may need to retain your information for a period of time in order to continue providing a service to you, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, prevent fraud, enforce our customer or user agreement, or take other actions as required or permitted by law.

Your right to be forgotten

Once services with us have ceased, and you are no longer an active customer, you can ask that we remove your data from our systems. This can either be requested in writing, or through the FidoNet Client Area. We will keep certain data, which we are required to do by law, for a period of time (as defined by statute or similar), after which time this data will also be expunged.

Communications

We will use your information in order to provide you with services, to communicate with you regarding those services and in relation to invoicing and delivery of services. We would also like to communicate with you regarding security announcements, maintenance and service affecting issues, as well as some marketing information. When you first signed up you were given the ability to opt into our communications. If you should change your mind at any time then you may change your communication preferences through the FidoNet control panel.
